Basic Trial Procedure

 

  • Jury selection
  • Opening statements
  • The prosecutor will present his case and the defense attorney may  cross examine the prosecution’s witnesses.
  • Defendant’s attorney  presents the Defendant’s case.
  • Closing arguments by the attorneys.
  • Jury instructions given by the judge to the jury.
  • Jury deliberations.
  • Verdict returned.
  • If the Defendant is found not guilty, the Defendant is released. If the Defendant is found guilty, the judge conducts a sentencing hearing and imposes the sentence in accordance with the applicable law.
  • Defendant may give Notice of Appeal
